Rear-end collisions are the most common types of car accidents, and the driver who rear ends the vehicle ahead is generally considered to be at fault. So if someone rear ends you, whose insurance do you call? Hi, I’m speaking on behalf of Hensley Legal Group, a personal injury law firm based out of Indiana. I’d like to discuss what you should do after a rear-end car accident. Regardless of who may be at fault, you should ALWAYS let your own insurance company know about your car accident as soon as possible. Depending on the terms of your policy, failure to alert the insurance company within a reasonable amount of time could constitute non-compliance, which may create an opening for the insurer to drop your coverage or refuse to renew it. Your insurance company has a duty to cover the damages incurred by another party if you are found to be at fault, so it will want to carry out an investigation into the car accident right away. The sooner you speak to your insurance company, the sooner this process can begin. Moreover, the sooner you get in touch with your insurance company, the sooner you can take advantage of any benefits that your policy may offer. Depending on the coverage you have purchased, you might be eligible to get reimbursed for medical payments, towing, car rentals, and repairs, among other benefits. Just as your insurance company might have to pay for the damages someone else incurs if you are liable for a car accident, another driver’s insurance company might have to pay for the damages you incur if that driver is liable. This is why the other insurance company needs to know about the car accident too, though you would still have to pursue a claim with that company or even file a lawsuit if you hope to get what you are owed. While you are certainly entitled to represent yourself, an insurance adjuster could use your inexperience against you in order to minimize the value of your claim.
