The reality is that there is no way to know up front exactly how long your lawsuit will take. Every truck accident lawsuit is different, with different fact patterns, injuries, defendants, and levels of insurance coverage. With so many variables, you can’t say with any certainty when a lawsuit will be settled, or even if it will be settled at all. To some extent, the Statute of Limitations may play a role. This is the maximum time that you have after an accident to file a lawsuit. If the Statute expires before your lawsuit is filed or your case is resolved, you could be forever barred from full financial recovery. But while the Statute of Limitations may dictate how much time might pass before your lawsuit needs to be filed, it does not determine how long it will take to settle your lawsuit. Understanding why a truck accident lawsuit might not be resolved as quickly as you would like may not bring you much comfort when you are being overwhelmed by collection notices. What can you do to make these notices stop and preserve your credit rating until your case is settled? The good news is that your creditors may agree to give you a break if they know they can be repaid out of your future settlement because they asserted a lien on your case. A lien is a legal right to someone else’s assets. These assets can be physical pieces of property, like a house, or something less tangible, like a settlement for a truck accident lawsuit. Creditors with liens on your case have a legal right to be repaid out of your eventual settlement or verdict. Once this right has been asserted, they may leave you alone until then, which can bring the notices to a halt and let you breathe a little easier.
