- Fatal accidents have gone down in Fort Wayne and Allen County since their peak earlier this decade, but there are still too many. Each one represents a life lost, and a family left suffering.
- A victim’s survivors often deserve compensation, but insurance companies may try to use Indiana’s “comparative fault” laws in order to blame as much as possible on your lost loved one and deny you what you should get.
- A Fort Wayne car accident lawyer can be someone on your side who will fight for you during your most difficult moments.
When you watch the local news in Fort Wayne – say on WANE – you might get a report of a car accident. Most don’t make the news unless one causes serious traffic problems or, tragically, a fatality. So you might not have a sense of how many car accidents there are in Fort Wayne or Allen County overall.
Luckily, the Indiana Criminal Justice Institute and the Indiana University Public Policy Institute keep track of the state’s car accidents. And while their 2024 Indiana Crash Facts Report showed good news for Allen County, a troublingly high number of accidents continue to occur, including fatal accidents in Fort Wayne.
Understanding the numbers can help keep you safe. If you are in a crash, or a loved one is involved in a fatal accident, working with a dedicated and compassionate Fort Wayne car accident lawyer can help you process your needs and gain the financial compensation you deserve.
The Numbers Behind Fatal Accidents in Fort Wayne
First the good news. Indiana, like every state, saw a spike in accidents and fatalities following the pandemic. But those numbers have slowly gone down, and in 2024 Allen County saw its fewest accidents since 2019.
That said, there are still too many. Allen County reported 12,878 total crashes that year. This makes us one of the most crash-prone counties in Indiana. That makes sense: Fort Wayne is a regional hub, bracketed by 69 and 469. The downtown area is always busy with delivery trucks and commercial traffic, especially along Highway 27 and near Parkview Field.
The huge majority of these reported accidents thankfully only involved property damage. But 2,270 of them inflicted non-fatal injuries and 38 were fatal – more than three fatal accidents every month.
The Factors Contributing to Fatal Car Crashes in Fort Wayne
Nearly every car crash is partly due to bad luck. Drivers make mistakes all the time but don’t get into accidents. Sometimes, though, two vehicles are in the wrong place at the wrong time, and this can be devastating.
In Fort Wayne and Allen County, there are a number of factors that can lead to fatal crashes, including:
- Changing speeds between rural and urban roads, often happening very quickly.
- Busy intersections with confusing traffic lights and left-turn patterns.
- Teenage drivers who might not be as careful.
- Drivers not looking out for motorcyclists.
- High numbers of trucks on the highway and delivery trucks on the street.
- Speeding (speed contributed to 11 of the fatal crashes in 2024).
- Alcohol, which was a factor in six of the region’s deadly accidents (shockingly, 15.8% of alcohol-related crashes resulted in death).
- Unrestrained occupants. Indiana drivers are buckling up less, and the number and types of injuries reflect that.
When there is a fatal crash, the surviving family members often seek financial recovery to pay for funeral costs, cover medical bills (if there isn’t an instant death), and get some level of compensation for their pain and suffering.
Each of these factors can complicate a case, though, and it is important to know how.
The Role of Comparative Fault in Fatal Accident Claims
Indiana is a “comparative fault” state. This means that if a loved one who was tragically killed in an accident was less than 51% responsible for the accident, then the family may be entitled to compensation.
But the law also can assign a percentage of blame to the “less than 51% guilty” party. How this works is straightforward, at least mathematically. If someone is 0% responsible for an accident, then 100% of the awarded recovery goes to that party. But if the injured party can be found to be, say, 20% responsible, then the amount awarded goes down by that much.
In a fatal crash, the insurance companies, who could be on the hook for a substantial amount, may try to use contributing factors to demonstrate comparative fault and lower what they have to pay. For instance, if your loved one wasn’t wearing a seatbelt, the companies could say that led to death (or at least made it much more likely). If both parties were speeding, then the lawyers for the insurance companies could claim that your loved one was maybe 30% at fault for the extent of his or her injuries.
It seems grim to have to fight insurance companies over percentages of fault when your loved one has been taken from you. But that’s the reality of the situation. And that’s why it is best if you don’t go it alone.
