On a Wednesday afternoon in April 2024, Pamela, a 46-year-old receptionist at an optometrist’s office, drove her SUV to the local high school to pick up her son.
Since the 15-year-old had a learner’s permit, Pamela let him take the wheel before the two set off for McDonald’s, although they never arrived because a Ford Fiesta suddenly blew through a red light at an intersection, sped into the path of their vehicle, and caused a T-bone collision.
“That’s an Airbag in My Face”
“I didn’t even know what happened at the moment,” Pamela recalled, “and then I realized ‘That’s an airbag in my face.’”
The airbag wasn’t Pamela’s only shocking realization either: “A man came to our door and said, ‘Don’t get out.’
“And we were like ‘What’s going on?’” she continued. “And I look over and come to find out the guy that we had hit that ran the red light, he had got out, and he was screaming and yelling at me and my son. And luckily there was an older man that was there and told him, ‘No, you get back in your car, and you hush until the police get here.’”
According to Pamela, the police ended up arresting the other driver when he was unable to produce a valid license, although “witnesses stayed around and said that he was the one that ran the red light, so it wasn’t our word against his.”
Various Severe Injuries Sustained
Pamela sustained various severe injuries in the crash, including contusions of the lung and the left knee, acute exacerbation of preexisting asthma from the airbag powder, and an “abnormality” in her left upper breast/chest wall that persists to this day. While the abnormality hasn’t been conclusively diagnosed yet, her doctors believe that it could be a posttraumatic seroma and have ordered regular ultrasounds for the foreseeable future.
The prospect of such a significant ongoing expense on top of the bills that she had already incurred from prior ultrasounds, mammograms, and x-rays for this incident was deeply troubling, as was the stiff resistance she had begun getting from the defendant’s insurance company.
Fortunately, it wasn’t long before Pamela discovered that she wouldn’t have to overcome these challenges alone thanks to a best friend named Alex who worked at a firm named Hensley Legal Group, PC.
“Absolutely, We’ll Help Her”
Pamela explained that she “told Alex what had happened, and she was like, ‘Let me talk to some people and see if we can’t help you.’ And they said, ‘Absolutely, we’ll help her.’”
Pamela has nothing but praise for her team at Hensley, which included attorneys Jessica Guldner and Mallory Slaton and case manager Lydia Walker, noting that “It was awesome to be able to know that y’all were taking care of me and my family.
“I hate to say this,” she continued, “but some companies just don’t do their jobs. You have to cry and remind them and remind them and remind them ‘Hey, I’m still here. I’m still hurting.’
“I didn’t have that with y’all. Y’all were the ones calling me saying ‘Here’s the update, here’s what’s going on, here’s what we need,’ so it was a very easy process after a very difficult situation.”
“It’s Too Hard for Us to Do It by Ourselves”
Based upon the strength of the case that the firm built, Pamela’s lawyers were able to obtain the full policy limits available from the defendant’s insurance carrier, but they didn’t stop there.
After informing Pamela of their intentions to try to get “a little more out of your insurance company,” her attorneys went on to secure additional funds from her underinsured motorist (UIM) policy, thereby allowing the family “to get another car because ours was totaled.”
Pamela was “very pleased” with her final compensation package, not least because she “did not expect it, honestly. You hear all the horror stories about how insurance companies just railroad you, and y’all didn’t let that happen.”
Asked what she would say to someone who was considering hiring Hensley, Pamela didn’t hesitate: “Do it. Do not try and fight that battle on your own because it’s too hard for us to do it by ourselves. And you know, Hensley got me a great settlement, and it was easy. I didn’t have to fight.”
