Shortly after midnight in October 2024, Mark, a 59-year-old factory worker, was driving his Subaru Legacy on Michigan St. and proceeding through a flashing yellow light at its intersection with Tibbs Ave. in Indianapolis, IN.
He had recently finished his shift at the transmission plant and was about a mile from his home when a Toyota Camry suddenly blew through a flashing red light on Tibbs Ave. and began speeding straight towards him.
“I Think I Did a Full 360”
“I tried to turn away from the impact, and boom, he hit me,” Mark recalled. “I think I did a full 360 because I wound up aimed the same way that I was going at first.”
Mark’s left wrist “hurt right away because I was gripping the steering wheel really hard, and it actually hit the wrist.” However, he was “fortunate that there was a paramedic just traveling along” who was able to stop, and he also received aid from an unexpected source.
“I’m not trying to give a shoutout to Apple or anything,” he explained. “I did not know that my Apple Watch had the feature of contacting my wife and emergency services, but it did that. I just felt it beep, and then it said that it seems like I’d been in an accident.”
Serious Injury Requiring Major Surgery
Mark’s wife rushed to the scene and took him to the emergency room, where his left wrist was X-rayed and splinted after a fracture was ruled out. Yet despite lower back pain radiating into his right leg that initially emerged on the car ride over and quickly grew more intense, that part of his body wasn’t examined until several days later, at which point he was diagnosed with sciatica and sent to physical therapy.
Only when Mark was still barely able to stand after more than three weeks was an MRI was ordered that revealed a symmetric disc bulge at L3-L4 with contact of the nerve roots, requiring a right L4-L5 transforaminal lumbar interbody fusion surgery followed by more therapy.
These extensive medical interventions kept Mark off work for the remainder of the year and forced him to go on short-term disability to make ends meet, and the bad news seemed to keep getting worse because “the kid who hit me, his insurance refused to cover it. They claimed that he was using his car for a business, and he wasn’t insured for that.”
“The Silver Lining in Things”
But although the other driver’s insurance coverage was officially off the table, Mark had one very good reason to “look at the silver lining in things.”
“I could tell early on, even before his insurance said that they weren’t covering it, that I’m gonna need help,” Mark said. “I always feel like you need people that are used to going through those types of things because I haven’t been in any accidents before where I was injured.”
And while Mark had seen “ads, commercials, and billboards” for Hensley Legal Group, PC before, he started coming across many more of them and believed it was “a testimony.
