On a Saturday morning in February 2025, Andy, a 60-year-old civil inspector for an Indianapolis engineering firm, was driving his employer’s truck down Main St. and proceeding through a green light at its intersection with Madison St. in Muncie, IN.
He had picked the Dodge Ram up from a service appointment about eleven minutes ago and was heading home, where he planned to keep the truck until he took it back to work on Monday. Unfortunately, Andy would never go back to work again because a Chevy Silverado blew through a red light and crashed into him.
“I Couldn’t Get Out of the Truck”
When the Silverado’s driver “jumped out of his truck” and tried to accuse him of running the red light, Andy was relieved that there was a witness present who “heard that guy and went, ‘No, you ran the red light.’”
Aside from preventing the other driver from blaming him, the witness also stood up for Andy when he couldn’t stand up for himself…literally.
“I had a big ol’ hematoma on my calf and up on my side, and my back hurt,” Andy recalled. “I mean, I couldn’t get out of the truck.”
Permanently Disabled Despite Four Surgeries
Andy’s worst fears were soon confirmed. The previous year, he had undergone “a surgery on my lower back to cage a couple of my vertebrae” after an on-the-job fall, and “when that guy ran the red light, he busted one of the bolts in that surgery.”
As a result, Andy required a new surgery to repair the damage that the old surgery had already addressed, along with two more surgeries shortly afterward to alleviate excessive post-surgical drainage and a fourth surgery to fuse three more vertebrae and replace his earlier hardware.
Yet despite four total surgeries, Andy was left permanently disabled. He can’t get around without a walker and certainly can’t return to his long-term career, maybe the most crushing blow so far.
“It’s hard to go from working all the time to not being able to work,” Andy said. “This has really been a big adjustment for me.”
Nonetheless, he’s grateful that he hasn’t had to make this adjustment alone, crediting the support he’s enjoyed from a wide range of sources.
“I mean, if it wasn’t for my faith and Hallmark Channel, I don’t know what I’d have done,” Andy quipped, quickly adding that “I’m dead serious. My faith has really carried me through. That and my awesome wife” – and, as he likes to “tell everybody,” Hensley Legal Group, PC.
“A Sign from God”
Asked why he hired Hensley, Andy didn’t mince words: “It’s a sign from God.”
“I’d seen some commercials on the TV while I was in the hospital,” he explained, “and then I was sitting at home, and I wasn’t even home a day” when the other driver’s insurance company called.
“I said, ‘Do I need a lawyer?’ And the lady goes, ‘Not really because that’s just going to drag it out, and it’s going to be a lot faster if you don’t have a lawyer.’ And then one of [the firm’s commercials] went across the TV, and I said, ‘I’m going to give them a call,’ and that was the greatest thing that I did.”
Andy’s team at Hensley included attorney Jessica Guldner and case manager Lydia Walker, and he couldn’t be more enthusiastic about how “you guys bent over backwards to help me.”
The firm didn’t neglect his emotional concerns either, with Andy singling out Lydia in particular for the way that “she just calmed me down” whenever “I was in a mood.”
“Don’t Trust the Insurance Companies”
Hensley’s tireless advocacy ultimately paid off. The firm obtained the maximum amount available for Andy’s injuries from both the defendant’s liability insurance policy and his employer’s underinsured motorist (UIM) policy and got him his full Social Security Disability benefits too.
Andy is beyond pleased with his final compensation package, which he believes is “going to more than last us the rest of our lives,” and he recommends Hensley to everyone he meets, telling them “Don’t trust the insurance companies. They’re going to try to pressure you into taking something that’s not beneficial to you. It’s only going to be beneficial to them. They’re going to lowball you. Always call a lawyer.”
