In October 2024, Diona and her husband Earl were returning from Chicago to their home in Anderson, IN. The trip had been long but mostly uneventful, outside of a brief encounter with someone who was “driving erratically and crazy” about ten miles before their exit, although Diona thought she had managed to bypass him.
Yet when they got off the highway and stopped at a red light, they “felt this boom from the back.”
“He Did a Hit-and-Run on Us”
“I look up in my rearview mirror, and I’m like, ‘Oh my gosh, this is the same man,’” Diona said. “I’m trying to understand, like, how did he do that?”
The two vehicles then pulled into a gas station, where Diona saw that the collision had “knocked off the whole back fender” of her new Buick Envista. And while the other driver was initially apologetic and repeatedly said “I’m sorry,” he became less cooperative once law enforcement was brought up.
“When I said, ‘Well, I’m going to have to call the police to make a report,’” she recalled, “he pulls out. He did a hit-and-run on us.”
“I Could Hardly Stand Up”
With the at-fault driver having fled the scene before the police could arrive, Diona and Earl were forced to navigate the aftermath of the crash on their own, which was particularly unfortunate because Diona’s injuries were so bad that she “could hardly stand up” when “talking to the officer.”
Diona was later diagnosed with trauma to the neck and left elbow along with severe lower back impairment, and Earl sustained a lower back injury too. Both of them had to undergo physical therapy in order to achieve peak medical improvement, though the pain in Diona’s back was so intense that she also required two epidural steroid injections.
During the recovery process, the couple had a tough time completing everyday tasks and taking care of their two-year-old son, whom they couldn’t lift or carry anymore. Yet as distressing as the family’s physical and emotional strains were, Diona was even more alarmed by the growing financial strain they faced from the bills that kept rolling in – and it wouldn’t be easy to get the funds necessary to pay them either.
“I did contact my insurance, but I was already, in my mind, going to be seeking a lawyer,” she said, “because I know from past experience with insurance that they only try to get the minimum. They don’t really try to get you back to where you’re supposed to be.”
